From January 1st, co-parents will be able to establish filiation with their children without having to go through the adoption procedure. Filiation with regard to joint parenthood will be established in much the same way as it is in regard to the father, said the Ministry of Justice.
Children born within a marriage, after January 1st, will automatically have parental ties with the co-parent. Children born out of wedlock can be recognised by the co-parent. Those born before January 1st can be recognised by the co-parent, irrespective of marital status.
As far as the child’s name is concerned, the same rule will apply for lesbian couples’ children whose filiation is established with the co-parent, as applies for children of heterosexual couples.
