“Brexit” could become a protected brand name

The term “Brexit” can be registered as a brand name for soft drinks, beers and cigarettes, according to EUIPOL (the EU’s appeal office for the protection of intellectual property). The institution had previously said that Brexit could not be used as a product name as it could be viewed in a neagative way by the 48% of British people who voted against the UK leaving the EU.

Brexit Drinks Ltd, the British applicant involved in the case, appealed against the decision to refuse their request to register their brand name. The appeal office said the word “Brexit” was not insulting or discriminating so could therefore be used as a brand name.
