More than 260,000 people in Belgium have extrajudicial mandates

Since Covid, extrajudicial protection mandates have had increasing success. In the first half of this year, 41,405 Belgians opted for this solution, compared to 34,136 over the corresponding period of 2021, according to figures from the Federation of Notaries, relayed by L’Echo and De Tijd on Thursday.

The judicial protection mandate consists of appointing a trustworthy person who will be responsible for making decisions and taking actions on others’ behalf with regard to managing their assets or even their person, if they are no longer capable of doing so themselves. It is thus an ideal instrument for establishing or finalising – if necessary – estate planning.

It can be used, including in difficult situations, to make a registered donation, modify a will, sell or donate a house or even carry out operations on a securities portfolio, for example.

To be valid, an extrajudicial mandate must be registered in the Central Register of Mandate Contracts.

Today, more than 260,000 people have extrajudicial mandates.
