Liege appeal – Belgian state appeals against Farid Bamouhammad on Wednesday

The first chamber of the Court of Appeal in Liege will examine the appeal lodged by Koen Greens (CD&V), Justice Minister, in the case of Farid Bamouhammad, on Wednesday at 9:00am. It is unlikely there will be any submissions at this stage. Mr. Geens lodged an appeal in the case of Farid Bamouhammad who was released on medical grounds by the president of the Court of First Instance on November 30th, 2014. He believes that the unilateral application by Farid Bamouhammad last November was not admissible, and that the judge who ruled on the third party proceedings on January 16th was not qualified to do so.

Mr. Bamouhammad’s defense team (attorneys Moureau and Neve) believe there can be no appeal due to the recent royal decree. The Court of Appeal in Liege will give its ruling on the admissibility of the proceedings and possibly on the appeal itself.

The case will be brought before the first chamber of the Court of Appeal on Wednesday. There should be no hearing at this stage as Farid Bamouhammad’s attorneys will ask that a timetable for the proceedings be established.
