The appeal against the decision made by Brussels court of first instance, which deemed the Jacques Boël paternity challenge regarding Delphine Boël inadmissible, was successfully brought before Brussels appeal court on Thursday. The next step is setting a date for the hearing. In 2013, Delphine Boël initiated proceedings before Brussels court of first instance to contest the paternity of Jacques Boël, her legal father, and to have King Albert II recognised as her "real" father.
Jacques Boël appealed the decision made by the court of first instance, which had ruled the proceedings contesting his paternity of Delphine Boël as inadmissible because procedure had not respected the legal deadlines. "The appeal was successfully lodged before Chamber 43 of Brussels Court of Appeal this morning,” announced Alain de Jonge, Delphine Boël's legal representative, also dealing with the appeal, on Thursday.
Last November, Brussels court of first instance had deemed the Jacques Boël paternity challenge regarding Delphine Boël inadmissible.
With regards to this paternity challenge, the court chose to submit two preliminary questions to the Constitutional Court.
In court, the different parties, Jacques Boël, Delphine Boël and King Albert II, made their submissions within the required timeframes. They will next all attend a court hearing, although the court is not expected to rule until early 2016.
