The imam from Dison (Verviers region), Shayh Alami, brought an appeal against his expulsion order signed by Theo Francken, Secretary of State for Asylum and Migration last July, in front of the Alien Litigation Council on August 11th, revealed Mr. Julian Hardy, the preacher’s attorney. The appeal, with suspensory effect, should be examined by the end of the year, if not in 2016, explained the attorney.
The attorney was reacting to last week’s declaration by Dison Alderman Yvan Yilieff, who questioned why the preacher was still effectively in his town when he should have left the country by August 27th at the latest following the expulsion order.
Dutch-Moroccan Shayh Alami, who has been a Belgian resident for over 10 years, is accused of disseminating Salafist propaganda and preaching in favour of violence and a holy war. “The Alien Litigation Council will examine procedures and the respect of the defence’s human rights; we are mostly protesting the fact that my client was not questioned before the secretary of state made his decision,” explains Mr. Hardy.
As part of the ongoing procedure, the Aliens Office has handed over the imam’s file to the Alien Litigation Council. A court session will then be scheduled in the next 4 to 6 months according to the attorney, in order to rule on the appeal. The final decision is not expected until the end of this year if not early 2016.
