The court of appeal in Liège decided on Tuesday to authorize the use of photos taken from a personal Facebook user as evidence material. It relates to a case whereby the victim of an attacked had uploaded the pictures on Facebook two days after the alleged incident.
His antagonist who stands accused of the aggression, had filed the pictures in order to show that the alleged damage was not as severe as the victim made it out to believe. The victim there after condemned the use of the picture saying using his private Facebook pictures violated the law and that it was against the copyright use of his images.
However, the court has now concluded that the pictures could be used in the framework of the court procedure and would be allowed to be handed to a specialist to evaluate the extent of the damage.
