Migrant Appeal Council opposes expulsion of Moroccan convicted of terrorism

The Secretary of State for Asylum and Migration, Theo Francken (New Flemish Alliance, N-VA), said on Thursday that he regretted not being able to expel a Moroccan previously convicted of involvement in the activities of a terrorist group. According to the Council for Migrant appeals, CCE, Belgium’s Immigration Service has not verified whether Article 3 of the European Convention on Human Rights, which bans torture and other forms of inhuman or degrading treatment, will be respected if the man is deported.

“I’ve already withdrawn the residence permit of this Moroccan jihadi,” Francken explained on his blog. “He has since been moved from his cell to a closed centre for illegals with a view to sending him back to Morocco.”

Francken wrote on his blog that the CCE decision to oppose the repatriation because of the risk that Art. 3 of the ECHR might be violated was “bad news”.

The CCE had blocked a previous expulsion to Morocco for the same reason.
