A tragic incident occurred when an 11-year-old girl, who had been placed in a hospital due to a lack of available spots in youth care facilities, became a victim of rape, according to the Brussels prosecutor’s office.

The prosecutor’s office highlighted that children are routinely placed in hospitals because even the most vulnerable often cannot find a place in youth care institutions. This situation is described as “institutional abuse,” currently under a criminal investigation for neglect.

On 2 May, the Brussels prosecutor’s office was notified by local police about the rape of an 11-year-old girl. She had been placed in a hospital by a juvenile court order due to a lack of space in the youth care network and while awaiting a more permanent solution. Her family environment and suicidal tendencies made returning home impossible.

The girl has been in a hospital ward unsuitable for her needs for over a month. While the assault did not occur at the hospital, it happened while she was outside its premises.

The prosecutor’s office stated that every day they face urgent situations requiring children’s hospitalisation to ensure their minimal physical safety. Such placements have a significant impact on Brussels’ already overburdened hospital system.

There is a severe staff shortage, making it impossible for these vulnerable children to receive appropriate care, the prosecutor’s office noted, adding that the entire paediatric medical chain is disrupted, delaying surgeries and preventing other children in need of urgent medical care from being admitted.

The prosecutor’s office regrets the structural shortage of places in youth care facilities, which prevents vulnerable youth from receiving timely and adequate support. The lack of investment in the sector has far-reaching consequences. The current situation is seen as institutional abuse, under investigation for criminal neglect.
