Three-year suspended sentence for abuse of vulnerable woman

A court in Veurne has sentenced a 35-year-old man from Nieuwpoort to a three-year suspended prison term for rape and violation of sexual integrity, under the condition that he meets certain requirements.

The defendant, A.B., engaged in sexual relations multiple times during the summer of 2023 with his partner’s sister. The victim, due to her mental limitations, is legally considered to have a prolonged minor status, with a mental age of three to four years, rendering her unable to give consent.

The case came to light when the victim disclosed the abuse to her legal guardian. Prosecutors and the victim’s representatives described the situation as particularly distressing, noting that A.B. took advantage of the circumstances when his partner was not home.

Although A.B. admitted to the offences, the prosecution recommended a four-year suspended sentence, factoring in his confession. Defence lawyer Jeroen Thieren argued that A.B. acknowledges his wrongdoing and is willing to undergo guidance to address his issues, seeking a lighter sentence on probation.

It’s reported that A.B. and his partner no longer have contact with her sister, and he plans to relocate inland to make a fresh start. During the proceedings, the accused expressed remorse, acknowledging the harm caused.

Ultimately, the court handed a three-year suspended sentence to A.B., requiring him to seek rehabilitation and forbidding contact with the victim. He is also deprived of civil rights for five years and must pay a provisional compensation of €1,250 to the victim’s representatives.
