USA: New York ban on weapons in bars and subway to remain in place for now

The U.S. Supreme Court has ruled that a New York law restricting the carrying of guns in “sensitive places” such as Times Square, schools, bars and hospitals may remain in effect for the time being.

The city and state of New York passed the law last summer in response to a ruling by the Supreme Court’s conservative majority that overturned a local law restricting permits to bear arms that had been in effect since 1913.

The Supreme Court's summer ruling perpetuated Americans’ right to leave home armed and allowed only “reasonable” exceptions that respect “the history and traditions of the United States.”

Eight days later, New York passed a new law banning the carrying of guns on subways, in stadiums, certain commercial establishments and other places. The Gun Owners of America group and individual gun owners then took the law to court.

A federal appeals court decided that law could remain in effect pending a ruling on the merits. Thereupon, gun advocates took their case to the Supreme Court.

At this stage of the proceedings, the majority of the court’s judges refused to adjudicate the issue, preferring to wait for the appeal court’s ruling on the merits.
