A New York judge on Thursday dismissed a third rape charge against former film producer Harvey Weinstein, citing the jury’s inability to reach a verdict, US media reported.
The decision does not affect the guilty verdict delivered the previous day for sexual assault.
One of the jurors refused to deliberate further. ABC News reported that the foreman of the jury was afraid to be in the same room with the other jurors, claiming that they had shouted at him to change his opinion.
On Wednesday, Weinstein was found guilty of sexual assault but was acquitted of another assault charge, while no verdict was reached on the rape charge.
This case was a retrial after Weinstein’s 2020 conviction was overturned last year. The 73-year-old was originally sentenced to 23 years in prison for the rape of Jessica Mann in 2013 and the assault of former production assistant Miriam Haley in 2006.
In the retrial, an additional charge of assaulting Kaja Sokola in 2002 was added; Sokola was 16 at the time, according to The New York Times.
